It is well settled law in Massachusetts that the lender's closing attorney is only required to protect the lender's legal interest and, absent some other agreement, does not represent the interests of the borrower. However, in Massachusetts, the borrower can hire a refinance closing attorney to handle the closing at no additional cost. The borrower then becomes a client of that attorney along with the lender. In this arrangement, the attorney now owes an obligation to protect the borrower's interests as well. This is where Silveri & Wilson can help.

The lender always discloses to the borrower what the customary refinance closing costs will be on a document called the Good Faith Estimate ("GFE"). The refinance attorney fees are noted in this document and rolled into the borrower's closing costs. Regardless of whether the lender's attorney handles the closing, or our office, these fees do not change. We can also provide you with a referral to a reputable mortgage lender.
